We take the responsibility of handling your data seriously. This Privacy Policy applies to all users of our Website, App, and Platform, and to all applications offered for general use.

Unless otherwise defined here, capitalized terms have the same meanings as in our Terms of Use or Terms and Conditions.

In the event of a personal data breach, we will notify you via email within seventy-two (72) hours.

We adhere to the individual redress principle, which gives individuals the right to pursue enforceable legal remedies if a data collector or processor fails to comply with applicable privacy laws. This includes access to courts or regulatory bodies to address non-compliance.

Data Retention

We will promptly delete the requested data unless retention is required to comply with legal obligations, resolve disputes, or enforce our agreements. If we no longer have a legitimate business need to retain your information, we will delete or anonymize it.

This does not include our hosting partners and other third parties who assist us in operating our Website, App or  Platform, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

We only use customer data for AI training when we have received clear, explicit consent and where such use is covered under appropriate licensing or contractual terms. This may include proprietary business data provided by customers.

We use certain tools provided by Google, a third-party vendor, to help us better understand how users engage with our Website, App, and Platform.

Colorado
The Colorado Privacy Act (Colo. Rev. Stat. § 6-1-1301 et seq.) protects the privacy of Colorado consumers.
Residents of Colorado have following privacy rights:
(i) you have the right to opt out of the processing of your personal data for the purposes of targeted advertising, the sale of your personal data or profiling in furtherance of decisions that produce legal or similarly significant effects
(ii) you have the right to confirm whether we are processing personal data concerning you and to access your personal data
(iii) you have the right to correct inaccuracies in your personal data
(iv) you have the right to delete your personal data
(v) when accessing your data, you have a right to obtain that data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit that data to another business.

Connecticut
BPR Hub does not sell, trade, or otherwise transfer to outside third parties your “Personal Data” as the term is defined under Connecticut’s Privacy Act and Act Concerning Personal Data Privacy and Online Monitoring.


Connecticut Laws permits residents of Connecticut who are Users of our Website or Platform that are Connecticut residents to request certain information regarding our disclosure of their Personal Information to third parties for their direct marketing purposes.

Further, Users have the right to:

(i) confirm whether or not we are processing your personal data and access such personal data, unless such confirmation or access would require us to reveal a trade secret
(ii) correct inaccuracies in the User’s personal data

Utah

The Utah Consumer Privacy Act (UCPA §13-61-102(1)) gives residents of Utah who are users of our Website the right to:

(iii) delete your personal data; and

New York

The New York Privacy Act sets strict rules about how businesses must handle consumers’ personal information and gives individuals new rights concerning data.

Virginia

12. FOR OUR EUROPEAN CUSTOMERS AND VISITORS

We are headquartered in India, and most of our operations are located in India, the United States, and Canada. Your personal information, which you provide to us during registration or use of our Website, App, or Platform, may be accessed by or transferred to us in the United States.

If you are visiting our Website or registering for our Services from outside the United States, please note that your personal information may be transferred to, stored, and processed in the United States. Our servers or our third-party hosting service partners are located in the United States. By using our site, you consent to any transfer of your personal information out of Europe, the United Kingdom, or Switzerland for processing in the U.S. or other countries.

  • If you are a resident of, or visitor to, Europe, you have certain rights with respect to the processing of your personal data, as defined in the General Data Protection Regulation (“GDPR”).
  • Please note that in some circumstances, we may ask you to provide additional information in connection with your request (such as verifying your identity). 
  • In such situations, however, we will still respond to let you know of our decision.
  • As used herein, “Personal Data” means any information that identifies you as an individual, such as name, address, email address, IP address, phone number, business address, business title, business email address, company, etc.
a. EU Standard Contractual Clauses

On June 4, 2021, the EU promulgated a new set of Standard Contractual Clauses (the “New SCCs”), which replaced the old SCCs that had been in place for over a decade.

We now comply with the New SCCs with respect to the transfer of personal data from the EU to the U.S. and other countries for processing, as defined in the GDPR. If there is any conflict between the terms and conditions in this Privacy Policy and your rights under the New SCCs, the terms and conditions in the New SCCs will govern.

b. The New SCCs
  • The New SCCs took effect on June 27, 2021. 
  • The Old SCCs may still be used for new data transfers in new contracts during a three-month transition period that ended on September 27, 2021. 
  • Existing data transfer contracts that relied on the Old SCCs could be used until December 27, 2022, by which time all transfers relying on the Old SCCs had to be transitioned to the New SCCs.
  • As of now, we and our customers are using the New SCCs to transport personal data from the EU to other countries, including the U.S., for processing by us.
  • You are the Controller (as defined in the GDPR) and the Exporter (as defined in the New SCCs) of the personal data. We are the Processor (as defined in the GDPR) and the Importer of such personal data.
  • You agree to comply with the GDPR rules that apply to Controllers and the New SCCs rules that apply to Data Exporters. We agree to comply with the GDPR rules that apply to Processors and the New SCCs rules that apply to Data Importers.
c. Our GDPR Compliance Commitment

We agree to fully comply with both the letter and spirit of the GDPR and the New SCCs with respect to the transfer of your personal data for processing outside the EU.

  • As a Data Importer, you may contact us (see subsection 9(d)) regarding the personal data we store and process about you.
  • We hereby notify you that we will be processing, as defined in the GDPR, the personal data of your authorized users (i.e., those individuals whom you have authorized to access our Platform and use our Services) in the U.S., Canada, and Turkey, in order to provide the Services as agreed in our definitive service agreement with you.
  • Upon request, we will provide you with a list of your personal data that we process and a copy of the New SCCs under which the data is transferred for processing.
  • We warrant that, at the time of agreeing to the SCCs for the transfer of your personal data, we have no reason to believe that the laws and practices applicable to us as a data processor and importer—including those of the U.S., Canada, and Turkey—are not in line with the requirements of the New SCCs.
  • If we are unable to fulfill a request or resolve a dispute to your satisfaction, we agree to arbitrate or litigate the matter in the EU jurisdiction in which you reside.
  • We will only transfer your personal data to a third country based on documented instructions from you. 
  • Your personal data will be transferred and stored in an encrypted format.
  • Only employees who need access to your personal data to fulfill our contractual and legal obligations to you will be given access. 
  • Such employees will be assigned a unique username and password. 
  • We maintain an automated log of all individuals who have accessed your personal data.
d. Rights of Data Subjects

‍13. FOR OUR CANADIAN USERS

This section supplements the information contained in our Privacy Policy above and applies solely to visitors, users, and others accessing our Website, App, or Platform from Canada (“consumers” or “you”). We comply with the Personal Information Protection and Electronic Documents Act of 2000 (“PIPEDA”). Any terms defined under PIPEDA shall carry the same meaning when used in this section.

  • Definition of Personal Information: Personal information includes any details about an identifiable individual, such as name, title, business contact information (e.g., address, phone number), and more.
  • Right to Access Personal Information: You may request access to the personal data we hold about you. Upon verification, we will explain how your data has been used, who it has been shared with, and provide a copy in an accessible format.
  • Right to Correction / Limited Right to Deletion: If you believe any of your personal information is inaccurate, you may request a correction or deletion. If validated, we will process the update within thirty (30) days and notify relevant third parties.
  • Right to Be Forgotten: Your information will be retained only as long as needed to fulfill BPR Hub’s service obligations. Unless otherwise notified, we will retain your data until your user account is terminated by you or us.
    Data Breach Notification: If a breach occurs that poses a “real risk of significant harm,” we will notify you as soon as feasible. A full breach log is maintained and can be made available to the Office of the Privacy Commissioner upon request.

  • Two-Factor Authentication: For enhanced security, you may enable two-factor authentication. A code will be sent to your registered mobile number after you enter your password, ensuring that only you can access your BPR Hub account.
